For a legally binding Will, the Testator must be of sound mind and of legal age.
1. To have your Will signed in the Consular Office you must provide:
- Proof of Greek citizenship, such as a Greek passport or a Greek identification card. Birth certificates from a Municipality or a Community in Greece would also do, even if issued a long time ago.
- Witnesses not related to you, or to one another. The witnesses must be Greek nationals who can provide a Greek passport, or a Greek identification card.
2. To deposit to the Consulate your HAND-WRITTEN, SECRET WILL, you must bring it in a sealed envelope to the Consulate and provide:
- Proof of Greek citizenship, such as a Greek passport or a Greek identification card. Birth certificate from a Municipality or a Community in Greece would also do, even if issued a long time ago.
- 3 witnesses not related to you, or to one another. The witnesses must be Greek nationals who can provide a Greek passport, or a Greek identification card.
3. Wills, of any kind, must go through the Greek Courts after the Testator's death. This means that before they can be executed, they need to be probated.
4. Proof of death of the Testator is needed before the Will is made public. If the person dies in Greece, a death certificate from Greece is needed ('Lixiarhiki Praxi Thanatou'). If the person dies in Australia, this certificate is issued by the Consulate upon submission of Australian proof of death.
